These Terms and Conditions (“Terms”) govern your access to and use of the website operated by Good Hill Real Estate LLC DBA Marks Forte, including MarksForte.com (the “Site”), and your interactions with the Mark Forte Real Estate brand through the Site, forms, calculators, appointment tools, email, telephone, and text messaging. By accessing or using the Site or our online services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or services.
1. SMS MESSAGING TERMS AND COMPLIANCE
Program Description
Our messaging program sends messages to individuals who have expressly opted in through a website form, appointment form, lead form, or other documented consent process. Messages may include responses to real estate inquiries, requested property information, home-search or home-valuation follow-up, appointment confirmations and reminders, scheduling or rescheduling updates, service notifications, educational or marketing messages where separately authorized, and customer-support communications.
Consent to receive marketing text messages is not a condition of purchasing any property, product, or service. Your consent applies only to the telephone number you provide. You represent that you are the subscriber or customary user of that number and are authorized to provide consent.
Opt-Out and Support Mechanisms
You can cancel the SMS service at any time. Just text “STOP” to 203-707-9809. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Message Frequency and Charges
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages at a frequency that varies based on your inquiries, appointments, requested services, and communication preferences. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Supported Carriers and Delivery
The messaging program is intended to work with major U.S. wireless carriers and many regional carriers. Availability and delivery are subject to your carrier’s network, device compatibility, and service availability. We do not guarantee that every message will be delivered.
Age Restriction
You must be at least 18 years old or have the permission of a parent or legal guardian to participate in the messaging program.

2. GENERAL WEBSITE TERMS
The Site provides general information, educational content, real estate resources, interactive tools, and methods to contact us. Your continued use after an update means you accept the revised Terms.

Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded.
10. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, Good Hill Real Estate LLC DBA Marks Forte AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ONLINE SERVICES.
THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. YOUR RIGHTS MAY VARY BY JURISDICTION.
11. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Good Hill Real Estate LLC DBA Marks Forte and its affiliates, owners, officers, employees, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or content you submit that infringes another person’s rights. This provision does not require you to indemnify any party for that party’s own unlawful conduct.
12. TERMINATION
We may restrict or terminate your access to the Site if we reasonably believe you have violated these Terms, threatened Site security, infringed another person’s rights, or engaged in unlawful conduct. Provisions that by their nature should survive termination will remain effective.
13. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Any dispute concerning these Terms or the Site will be brought in a state or federal court with proper jurisdiction in Connecticut, unless applicable law requires otherwise. Nothing in this section prevents either party from seeking relief in small claims court or pursuing another remedy that cannot lawfully be waived.
14. SEVERABILITY; WAIVER; ENTIRE AGREEMENT
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law. A failure to enforce any provision is not a waiver.
